The terms and conditions herein shall be read together with this Supplementary Agreement and the standard terms and conditions of MBF Cards (M'sia) Sdn Bhd ("MBFC")'s Card Agreement ("Card Agreement"). In the event of any discrepancy or inconsistency between this Agreement and the Card Agreement, the terms of this Agreement shall prevail in so far as applicable to MBF Cards Got "5" Get RM500,000 Contest ("Contest"). |
The Contest Mechanics and Eligibility |
|
|
|
| 1. |
The 'Got 5 Get RM500,000 Contest' ("Contest") shall be held from 7 April 2008 at 00:00:00hrs / 12:00:00am to 28 September, 2008 at 23:59:59hrs / 11:59:59pm ("Contest Period") and will close at the end of the Contest Period or such other time that MBFC shall decide from time to time. The Contest Period runs for a total of 25 weeks. |

|
| 2. |
The beginning week will be on a Monday, 00:00:00hrs / 12:00:00am and the ending day of the week on Sunday 23:59:59hrs / 11:59:59pm. The new week resumes the following day, Monday 00:00:00hrs / 12:00:00am. |
|
|
|
| 3. |
There are two (2) tiers to this Contest. Contestants are eligible to win the following cash prizes if they are able to get '5' in the last digit of the 6 digit approval code on their transaction slip :-
Tier 1 - 205 x RM50 ("Daily Cash Prize") to be won on a daily basis for the duration of the Contest Period.
Tier 2 - 1 x RM500,000 ("Grand Prize') at the end of the Contest Period. |

|
| 4. |
Both Principal and Supplementary MBFC CardMembers ("Contestants") are entitled to participate on an independent basis only and any attempt to combine or merge their transactions will be disallowed. |
|
|
|
| 5. |
To enter the Contest, CardMembers ("Contestant") are required to conduct a retail transaction or an Over-The-Counter Cash Advance using their MBF credit card ("Card") and have swiped it physically to obtain a transaction slip. |
|
|
|
| 6. |
The minimum value of that retail transaction must be RM50. |
|
|
|
| 7. |
If the last digit of the 6 digit approval code on the transaction slip is number '5' ("Approval Code 5) the Contestant must register it within 24 hours ("Entry") from the point when the transaction was made otherwise it will be disqualified :- |
|
|
|
| |
a) |
For all local transactions (Within Malaysia)
Contestants are required to register Approval Code 5 via SMS and sending it to 39366. The Contestant must ensure that their Contest Entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified. There will not be any notification sent to alert the Contestant of any errors in their Entry / Entries. Upon registration, there will be an acknowledgement SMS (charged at RM0.30 per SMS) sent from MBFC to the Contestant that only confirms receipt of the entry, not the winning of the Cash Credit. Proof of SMS sent by a Contestant does not denote proof that the SMS was received by MBFC.
If the SMS date and time of the registration differs from that of MBFC's system date and time, and a dispute arises as to when the registration has taken place, MBFC's system date and time shall prevail. |

b) |
For all overseas transaction (Outside Malaysia)
Contestants are required to register their Approval Code 5 by calling our MBFC's Customer Service Centre at +603-21670555. This number is solely for the purpose of Contestants who are transacting overseas and registering their approval code ending with "5" from such transactions. All calls registered will be based on Malaysia's local date and time (GMT +8 hours). |

|
| Disqualification |
|
|
|
| 8. |
MBFC reserves the absolute right to disqualify any of the registered Entry(ies) without having to notify or alert the Contestant based on the following:- |
|
|
|
| |
a) |
All Entries received before and after the stipulated Contest Period. |
|
|
|
| |
b) |
Inaccurate or incomplete Entry(ies). |
|
|
|
| |
c) |
Entry(ies) with transaction(s) value of less than RM50. |
|
|
|
| |
d) |
Entry(ies) arising from Split Transactions, defined as follows- |
|
|
|
| |
|
(i) |
Contestants having multiple transactions of more than five (5), other than Over-The-Counter utility bill payments, on the same day using any of the Contestants MBF credit card at the same card acceptance terminal shall be disqualified. For verification purposes, Contestant is required to retain his/her actual paid utility bill for Over-The-Counter utility bill payments. |

|
| |
|
(ii) |
Voiding transactions more than twice on the same day at the same card acceptance terminal to attain an approval code ending with "5" shall be disqualified. |
|
|
|
| Exclusions |
|
|
|
| 9. |
Transactions excluded are all fees, all cash advances (except over-the-counter), Corporate Bill Payment, Corporate GIRO transactions, CALL'n Pay, CLIK'n Advertise, CLIK'n Shop, CLIK'n Pay, mBILLPAY, mRELOAD, mPAY, AutoBILLPAY, all Mail Order, Telephone Order, Internet transactions and transactions which are under special corporate arrangement where rebate is applicable and all/any financial charges. |

|
| Card Account in Default |
|
|
|
| 10. |
To be eligible for the Daily Cash Prize and the Grand Prize, the Contestant's Card account shall not be in default of facilities granted at any time during the Contest Period, subject to MBFC's discretion; and/or holder(s) of MBF Cards credit card(s) whose accounts have been closed on or before 28 September 2008. |
|
|
|
| Adherence to Contest Terms and Conditions |
|
|
|
| 11. |
All Contestants shall be required to adhere to the Contest Terms and Conditions. MBFC reserves the right to forfeit the prize(s) in the event of any of the Terms and Conditions are not adhered to. |
|
|
|
| Winnings |
|
|
|
| 12. |
Winning the Daily Cash Prize (RM50)
Selection of the Winners
Time is of the essence. The first 205 registered Entries on a daily basis with Approval Code 5 based on the time of the registration of the Entries for transactions made within the same day (00:00:00 hrs to 23:59:59 hrs or 12:00:00am to 11:59:59pm) will be awarded with a Cash Prize of RM50 for each Entry as long as these Entry/(ies) are not in breach of the items defined in clause 8. If the date and time of the registration of the Entry or the transaction differs from that of MBFC's system date and time, and a dispute arises as to when the registration of the Entry or the transaction has taken place, MBFC's system date and time shall prevail.
Notification
MBFC will notify Contestants via SMS within five (5) working days of their winning Entry(ies) for which the contact number shall be the number used by the Contestant for submission of the Entry(ies). Notwithstanding the foregoing, MBFC reserves the right to use any other method or medium MBFC deems fit at its sole and absolute discretion for the purpose of announcing the Contest winners. The Cash Prize shall be credited to the Contestant's Card account and reflected in the subsequent Card Statement, itemised under "GOT 5 Contest - Approval Code Winner". |

| 13. |
Winning the Grand Prize (RM500,000) |
|
|
|
| |
Non eligibility
The following person/persons are NOT eligible to participate in the Grand Prize Event: |
|
|
|
| |
a) |
Permanent and/or contract employees of MBFC (including it's subsidiaries and related companies) and their immediate families (parents, spouse and children); |
|
|
|
| |
b) |
Representatives and/or agents (including advertising and promotions agents) of MBFC and their immediate families (parents, spouse and children).
|
|
|
|
| |
Selection of the Top 125 Finalists: |
|
|
|
| |
a) |
A total of 5 Contestants will be selected as Finalists for each week throughout the Contest Period as Finalists to participate in the Grand Prize draw (A total of 125 Finalists). |
|
|
|
| |
b) |
The top 5 Contestants will be selected weekly based on the submissions with the most number of registered Entry(ies) accumulated weekly. These registered Entry(ies) need not necessarily have won the Daily Cash Prize but it must not be in breach of the items defined in clause 8. |
|
|
|
| |
c) |
The top 5 Contestants each week will secure a place as one of the Finalists for the Grand Prize. |
|
|
|
| |
d) |
The names of the week's top 5 Contestants will be posted on the MBFC website, www.mbfcards.com after the second (2nd) week of the Contest Period. These names will be listed in alphabetical order and will feature the top 5 Contestants of the previous week. |
|
|
|
| |
e) |
In the event of a tie, time will be of essence hence the date and time of receipt of the registered Entry(ies) (based on the time indicated on MBFC's system date and time) will be used as the tie breaker. |
|
|
|
| |
Notification of the Top 125 Finalists: |
|
|
|
| |
a) |
The top 5 weekly Contestants will receive a SMS, supported by a notification letter sent from MBFC to inform them that they have secured a place amongst the final top 125 Finalists to vie for the Grand Prize Event. |
|
|
|
| |
b) |
MBFC will notify the final top 125 Finalists by way of a telephone call to the Finalists mobile phone for which the contact number shall be the number used by the Finalists for submission of the Entry(ies). Following which, it will be accompanied with an official letter of invitation requesting the Finalist's presence to a ground event ("Event") to contest for the Grand Prize. |

|
|
| |
c) |
MBFC does not cover any expenses incurred by the Finalists to attend the Event. |
|
|
|
| |
d) |
In special situations, and subject to the absolute discretion of MBFC, a Finalist may nominate a designated proxy to represent the Finalist in the Event. The proxy will be required to present written authorisation from the Finalist and identification which includes a photograph (examples include identification card/drivers licence/passport which displays a photograph) for the both the Finalist and the proxy. |

|
|
| |
Selection of the Grand Prize Winner |
|
|
|
| |
a) |
At the Event, all 125 Finalists will compete for the Grand Prize. There will be only one winner for the Grand Prize and the rest of the 124 Finalists will be entitled to a consolation prize. |
|
|
|
| |
b) |
MBFC will appoint an external auditor for the sole purpose of being an independent observer. All references to a Finalist's status as a "winner" are subject to MBFC's verification and auditing. If verification activity or audit evidences non-compliance of an Entry/(ies) with the Official Rules as determined by MBFC in its sole discretion, MBFC reserves the right to disqualify the Finalist. |
|
|
|
| |
c) |
The Grand Prize will be given out in the form of a cheque made out in the Finalist's name and is non-transferable. The selection of winning Finalist for the Event by MBFC is final. No correspondence disputing their decision will be entertained. |
|
|
|
| |
d) |
MBFC reserves the right to change any aspect of the Event (including postponement). |
|
|
|
| Publicity |
|
|
|
| 14. |
MBFC reserves the right, at its sole and absolute discretion, to use the nicknames, names, photographs, voice or video recordings and entries of the Contest winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media. |
|
|
|
| Liability |
|
|
|
| 15. |
MBFC shall not be responsible or liable for: |
|
|
|
| |
|
(i) |
any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a SMS as a result of any network, communication or system error, interruption and/or failure experienced by the telecommunication service provider. In the event of such error, interruption and/or failure, MBFC shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time. |
|
|
|
| |
|
(ii) |
any problem, damage or loss of whatsoever nature to any Contestant, or their authorised representatives resulting from their participation in the Contest. |
|
|
|
| |
|
(iii) |
any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. |
|
|
|
| Judging |
|
|
|
| 16. |
Judges decision shall be final and binding and no correspondence will be entertained. |
|
|
|
| |
|
|
|
| Variations to Terms & Conditions |
|
|
|
| 17. |
MBFC reserves the right to change any aspect of the Terms and Conditions of this Contest (including changing and postponement) without prior notice.
|
|
|
|
| Language |
|
|
|
| 18. |
If there are discrepancies between Bahasa Malaysia, Chinese and English versions of Terms and Conditions, the English version shall prevail. |
