In this terms and conditions: |

|
| |
a) |
the expression of “applicant” refers to MBF CardMember in the Payment of MBF Cards Credit Card Bills via . Registration Form overleaf who apply for Direct Debit Service. |
|
|
| b) |
the expression of “Bank” refers to the applicant bank, selected by the applicant where his/her/their bank account is maintained. |
|
|
| c) |
the expression of “Direct Debit Service(DDS)” refers to direct debit payments whereby applicant’s account is debited once the payment instruction from the Payee is received. |
|
|
| d) |
the expression of “Payee” refers to MBF Cards (M'sia) Sdn. Bhd. that subscribes to this service. |
|
|
| e) |
the expression of “Billing Account” refers to MBF Cards CardMember’s credit card account. |
|
|
| f) |
the expression of “Billing Account Number” refers to MBF Cards CardMember’s credit card number. |
|
|
| 2. |
An applicant must duly complete and sign on the form before submitting to the Payee. |
|
|
| 3. |
My/Our first payment to the Payee shall commence only upon receipt of the first payment instruction from the Payee subject to the application being accepted and approved by the Bank and the Payee. |
|
|
| 4. |
I/We shall settle all outstanding moneys under this Billing Account as itemized in the Payment of MBF Cards Credit Card Bill via . Registration Form directly with the Payee until the Direct Debit Service (DDS) is effected. |
|
|
| 5. |
Should the registered subscriber be someone other than myself/ourselves, the Bank shall not be required to enquire whether the registered subscriber’s name in the Payee’s record is the same as that stated by me/us on this form. |
|
|
| 6. |
I/We undertake to ensure that sufficient funds are kept in my/our account to meet the above authorization and payment. The Bank is under no obligation to effect the DDS if there are insufficient funds in my/our account to meet the above authorisation. If my/our account is overdrawn, I/we shall on demand by the Bank make good any amount overdrawn plus any interest payable thereon. |

| 7. |
Where there is sufficient available funds in my/our account, but the same is insufficient to pay on all the debit instructions, the Bank may in its absolute discretion elect not to make any payments on all debit instructions, and/or to determine the order of priority of payment of any debit instruction the Bank deems fit, in which event I/we shall be responsible to pay the Payee directly. The Bank is under no obligation to notify me/us of the debit instructions rejected due to whatsoever reasons. I/We request and authorise the Bank to re-attempt to debit the amount due from my/our account on any other date(s) subject to further instruction(s) from the Payee. |

| 8. |
The Bank shall not be held responsible or liable to me/us for any claims, loss, damages, cost and expenses (including consequential incidental general, special and indirect loss or damage or claims made on me/us or by any third party) arising from the successful or unsuccessful debit instruction due to whatsoever reason and wrongful debit of account due to inaccurate information provided by me/us or the Payee and other factors beyond the reasonable control of the Bank. Under such circumstances, I/we shall seek recourse or resolve the payment directly with the Payee. |

| 9. |
The Bank may at its absolute discretion terminate this request and authorisation for future payments at any time by notice in writing to me/us or without notice at any time after advised by the abovementioned Payee that no further payment is required, or without assigning any reason therefore. |
|
|
| 10. |
This request and authorisation for payment will remain effective for the protection of the Bank in respect of payments made in good faith notwithstanding my/our death or bankruptcy or dissolution or winding up the revocation of this request and authorisation for payment by any other means until further notice of my/our death or bankruptcy or such revocation is received by the Bank. The notice of termination by me/us or from the Bank shall not affect those bill(s) or charges incurred by me/us prior to the date of termination. |

| 11. |
I/We must notify the Bank and the Payee by giving 21 days notice of the termination of the DDS by me/us or changes in my/our account number and/or the Billing Account Number. In any event, such notice will only take effect on the date of receipt by the Bank. Any notice sent by the Bank to my/our last registered address with the Bank is deemed to have been received by me/us. |

| 12. |
Instruction amount which exceed the limit specified in my/our authorisation shall be rejected by the Bank, in which event I/we shall be responsible for paying the Payee directly. In this respect, I/we authorise the Bank to release details of my/our account to the Payee, and to obtain details of any payment(s) due from me/us from the Payee. I/We further consent to such disclosure and declare that the Bank shall be under no liability for disclosing such information. |

| 13. |
The Bank reserves the right at any time: |
|
|
| |
|
13.1 |
without prior notice to discontinue, interrupt, withdraw or suspend this DDS in whole or in part as the Bank deems fit and without assigning any reason whatsoever, and the Bank shall not be held liable for any loss or damage which may be suffered by me/us or any other third party registered under the DDS as a result of such action by the Bank. |

13.2 |
to vary, add, delete or amend any of the above conditions without notice. Such amendments shall become effective on such date as the Bank may elect to adopt, and the continued use of the DDS by me/us shall constitute acceptance of the said amendments. |
|
|
| 14. |
Notwithstanding the above conditions of the DDS, I/we shall be bound by the Bank’s conditions governing the operations of my/our account stated above which shall be construed in accordance with the Laws of Malaysia. |
|
|
| 15. |
In consideration of the Bank agreeing to provide the DDS, I/we hereby undertake to indemnify and hold the Bank harmless and indemnified against all actions, proceedings, claims, damage, cost, expenses, demands and losses which the Bank may incur or sustain by reason of the Bank carrying out the above request and authorisation by me/us, whatsoever arising from the DDS and/or arising from errors or omissions on my/our part and/or the Payee. |

| 16. |
The Bank may request additional information prior to approving the application and applicant shall furnish the requested information to the effect. |

MBF CARDS (M’SIA) SDN BHD
TERMS AND CONDITIONS FOR PAYMENT OF MBF CARDS CREDIT CARD BILLS

|
| 1. |
The expression of service refers to Payment of MBF Cards Credit Card Bills via CardMember will have to make an express request to MBF Cards to register the use of the service. The service provides that you may instruct us via telephone to request for payment to be released from your selected Bank/s (Savings and/or Current Accounts) directly to MBF Cards (M’sia) Sdn Bhd.

| 2. |
If the selected Bank(s) and MBF Cards approve the CardMember’s application, the CardMember shall be notified of the acceptance and the commencement date of the service. MBF Cards shall at our absolute discretion, and without assigning any reasons thereto, reject the CardMember’s application to register to use the service. |
|
|
| 3. |
CardMember may at any time instruct MBF Cards via telephone to request for payment in full or part to be released to MBF Cards (Msia) Sdn. Bhd. from the selected Bank(s) Savings and/or Current Account(s). However, telephone calls received on Saturday, Sunday and Public Holidays will not be processed until the next working day. CardMember must call MBF Cards (M'sia) Sdn. Bhd before 3.00pm in order for the payment to be credited to the CardMember’s account the next working day. It is the CardMember’s responsibility to allow sufficient time to process payments before the payment due date. |

| 4. |
All payments made by the principal and/or supplementary CardMember shall be used to reduce the outstanding balance of the credit card account. |
|
|
| 5. |
Once the CardMember instructs payment via the , it is conclusive instruction that shall not be revoked or changed for whatsoever reason. |
|
|
| 6. |
The Customer Service staff shall require the CardMember to identify themselves with certain relevant particulars or information and only upon satisfaction, the staff will accept the CardMember’s instruction via telephone prior dealing with the selected Bank(s). |
|
|
| 7. |
All instructions via telephone conversation will be audio recorded as documentary evidence to be adduced in Court if the need arises in any circumstances. |
|
|
| 8. |
All approved transactions are provided with a reference number in order to effect the bill payment with the Bank. Once the approved transaction with the Bank is debited and the CardMember’s account is credited, the transaction shall not be cancelled nor revoked for whatsoever reason by the CardMember. CardMember will be required to pay RM1.00 as a service charge to process each payment transaction. It will be debited in your credit card Statement of Account. Reference number is for the purpose of internal office use and moreover denotes confirmation of teleconversation confirming instruction of the . |

| 9. |
If the selected Bank rejects the transfer of payment from the CardMember's Savings and/or Current Accounts for whatsoever reasons, the CardMember shall be imposed with a handling fee of RM100 into his/her credit card Statement of Account. |
|
|
| 10. |
If payment is not received or is rejected by the Bank for whatever reason, MBF Cards (Msia) Sdn. Bhd. shall not be liable nor responsible for any claims, damages, losses, cost suffered or incurred by the CardMember arising from the default of the CardMember’s credit card account which includes late payment, penalty interest and interest charges. |

| 11. |
The service approval will be notified in writing by MBF Cards and be effective within 30 days from the date of approval by the CardMember’s Bank. All the CardMember’s enquiries and claims pertaining to matters on his/her Saving and/or Current Account shall be directed to the CardMember’s selected Bank. |
|
|
| 12. |
MBF Cards shall be released or waived or exempted from all legal responsibilities arising from any claims, damages or loss which the CardMember may incur and/or suffer in respect of any matter arising from the CardMember’s usage of this service including but not limited to non-payment by the selected Banks, rejection or payment by the Banks and incorrect payment amount/details. |

| 13. |
MBF Cards reserve the right to withdraw or suspend the availability of the service (or payment for specific MBF Cards credit card bills) at its absolute discretion with or without prior notice and shall be entitled to terminate the availability of the service (or payment for specific MBF Cards credit card bills). |
|
|
| 14. |
MBF Cards reserve the right to contact the CardMember for any enquiry, verification and monitor, retain or disclose any information to satisfy any applicable law, regulation, legal process or request from government authorities. |
|
|
| 15. |
Any notice from MBF Cards shall be deemed to have received five (5) days after mailing to the CardMember at the CardMember’s last known address provided to MBF Cards. |
|
|
| 16. |
MBF Cards reserve the right to alter or vary these Terms and Conditions at any time without giving any prior notice and the CardMember shall be bound by such amendment and prevailing Terms and Conditions. |
